These terms apply to Kiwiana Tours Limited bookings, student behaviour, itinerary changes, cancellations, risk and participant responsibilities.

By booking or participating in a Kiwiana Tours Limited tour, you agree to the terms and conditions below.

Important

Travel includes risk

Adventure, transport, accommodation and third-party activities may involve risks. Kiwiana Tours takes reasonable care in planning and supplier selection, but travellers must follow instructions and understand that external events can affect a tour.

Pastoral care and participant expectations

Kiwiana Tours Limited ("KTL") complies with the Education (Pastoral Care of Tertiary and International Learners) Code of Practice when conducting tours involving international students in its care.

We expect all participants to contribute positively to the tour experience, fit in with the group, and assist with general responsibilities such as tidying shared spaces, meal-related tasks, and other reasonable requests made by tour managers.

Risks

Activity operators involve an element of risk. KTL will not allow an activity if we regard the conditions, including weather or flooded rivers, as too dangerous.

KTL is not liable for any event or change of itinerary that is beyond our control, including severe weather conditions, natural disasters, industrial action or similar events.

Whilst we take all reasonable care with selecting accredited activity operators, accommodation providers, airlines and optional activity providers, each operator and agent, including their employees, agents, officers and directors, excludes to the fullest extent permitted by law any liability for loss, damage or injury, whether direct, indirect or consequential, suffered by a guest or any person associated with the guest in relation to the booked activity.

All activities have elements of risk. To the extent permitted by applicable law, all warranties, representations and implied terms are excluded. Where companies other than Kiwiana Tours run a portion or all of a tour, the terms and conditions of those companies also apply.

These terms and conditions are subject to the rights and remedies you have under the Consumer Guarantees Act 2003.

Travel insurance

Kiwiana Tours recommends a comprehensive travel insurance policy at the time of booking. This should cover medical expenses, loss of luggage, cancellation fees and other relevant travel risks.

Changes to itinerary

Kiwiana Tours reserves the right to cancel a tour if fewer than the minimum number of eight passengers are booked, amend tour schedules with no additional charge or refund to the traveller, and offer an alternative tour or future tour in lieu of any refund.

Kiwiana Tours reserves the right to make changes to itineraries or cancel any trip, including a guaranteed trip, at any time prior to departure if Kiwiana Tours deems it necessary, including due to natural disasters, political instability, terrorism, weather, cultural conditions or other external events.

It is important that travellers download the most up-to-date information from our website just prior to departure. Optional activities are contingent upon the tour schedule and may change without notice due to time availability or weather conditions.

High school tours

All products listed under High School Tours are exclusively available for individuals aged 14 to 17.

Permission for tours

All high school students aged 14 to 17 and under must have permission from their natural parents and from their school to join tours offered by Kiwiana Tours. Permission details are required as part of the booking process.

Kiwiana Tours policy for all high school students attending secondary school in New Zealand is that under no situation or circumstance is the purchase or drinking of alcohol, smoking cigarettes, illegal drug use or inhalation of a chemical substance allowed. This will not be tolerated on any Kiwiana Tours tour.

If a student breaches this policy, they may be sent back to their homestay, the school will be informed, no refund will be provided, and the cost of returning the student will be at the student's cost.

Cancellation policy

If Kiwiana Tours needs to cancel a tour for reasons beyond our control, a 10% fee of the purchase price may be charged to cover costs already incurred. If no costs have been incurred, we will refund 100% of money received or move your booking to an alternative date at no extra charge.

For 1, 2, 3 or 4 day tours, where notice of cancellation is provided more than fourteen days before the scheduled departure date, the customer is entitled to a refund of monies paid, less any applicable cancellation fee.

For 1, 2, 3 or 4 day tours, where notice of cancellation is provided fourteen days or fewer before the scheduled departure date, no refund is payable under any circumstances.

For 7, 11 or 15 day tours, where notice of cancellation is provided more than thirty days before the scheduled departure date, the customer is entitled to a refund of monies paid, less any applicable cancellation fee.

For 7, 11 or 15 day tours, where notice of cancellation is provided thirty days or fewer before the scheduled departure date, no refund is payable under any circumstances.

Failure to pay the full amount before the date of departure will be deemed a cancellation by default.

Transferring tours

If you wish to transfer to another tour and space is available, an administration charge of $10 will apply.

Itinerary variations

KTL reserves the right, at its sole discretion, to amend, vary or alter any itinerary and to allocate clients to separate vehicles or groups as operationally required.

Such changes may be made without liability for compensation, refund or damages where reasonably necessary due to circumstances beyond KTL's control, including adverse weather conditions, mechanical breakdowns, safety considerations, or the modification or cancellation of third-party activities or services.

KTL reserves the right, without payment of compensation, to require you to withdraw from or leave the tour if, in the opinion of KTL representatives, your behaviour or physical or mental condition may endanger the health, safety, interests or welfare of yourself or others.

Kiwiana Tours reserves the right to contact legal guardians or agents of any tour participant whose actions cause problems or tour disruption that may endanger the health, safety or welfare of themselves or others, or negatively impact the enjoyment of the tour group.

Kiwiana Tours reserves the right to remove any at-risk tour traveller in a safe and well-arranged manner. In such cases, no refunds will be paid and any costs incurred by Kiwiana Tours for such arrangements will be at the cost of the traveller.

When refunds are not available

KTL is under no obligation to refund money where circumstances beyond KTL's control require alternative arrangements to be made to ensure the safety, further participation or enjoyment of the tour.

KTL is under no obligation to refund money where you miss any part of the tour, including sightseeing, do not use the accommodation, or leave after the tour has started.

KTL is under no obligation to refund money in respect of flight or transport costs.

KTL rules for high school students

KTL rules and the laws of New Zealand apply at all times. If you are found breaking KTL rules or New Zealand law, you will be sent back to your host family at your own cost with no refund from KTL.

The KTL rules may be amended from time to time at the discretion of KTL. The applicable KTL rules will be outlined by your Tour Manager at the commencement of your tour.

  • No buying, possession or drinking of alcohol.
  • No possession or smoking of illegal drugs or inhalation of chemical substances while on tour, regardless of age or New Zealand liquor licensing rules.
  • Do not behave in a way that may endanger the health, safety, interests or welfare of yourself or others.
  • No smoking.
  • Speak in English unless all other people present share the language you are speaking.
  • Treat people, accommodation and the coach with respect.
  • Only participate in activities for which KTL has written permission from your natural parents.
  • The Tour Manager's decision is final in respect of enforcement of the KTL rules.
  • Seatbelts must be worn whenever the vehicle is in motion, and no walking around the vehicle while the coach is moving.
  • Rubbish must be put into the waste bag provided on each vehicle.

Permission forms

Written permission from your natural parents is required to join a KTL tour and participate in optional activities. Your parents must complete and submit permission requirements before the start of the tour. This applies to anyone under 18 years of age or anyone who attends a high school in New Zealand.

Lost property

Please name property and keep valuables on your person or locked away. KTL will dispose of any property that is left or returned to KTL and not claimed within three months from completion of your tour.

KTL is not responsible for items forgotten or left behind during or after the tour. We will make our best effort to remedy a notified loss and to have items returned to the traveller. The burden of responsibility for personal items while on tour remains with each traveller.

Facebook and photo waiver

By agreeing to these terms and conditions, any photographs taken on a tour by KTL staff or provided to KTL by you, including photographs with you in them, may be used by KTL for promotion and advertising, including website, Facebook and other media.

Personal responsibility

KTL and its representatives take all practicable steps to identify and minimise potential dangers for all participants on tour. However, to the extent permitted by law, KTL, its staff and management do not accept liability for accident or injury to you or your property.

We reserve the right to withdraw you from an activity if, in our opinion, you are likely to endanger yourself or others. We also reserve the right to cancel any activity if we become concerned for any reason for your safety or that of any other person.

You must notify the Tour Manager or another KTL representative if you are concerned for your safety while on tour.

  • KTL is not responsible for mechanical breakdowns, government actions, weather, acts of God, strikes or other circumstances beyond our control.
  • KTL is not responsible for your failure to follow instructions, including check-in and check-out places and times.
  • KTL is not responsible for loss of or damage to participants' baggage or its contents.
  • KTL is not responsible for activities cancelled due to weather conditions, including weather-dependent activities such as skydiving.

High school student behavioural agreement

While on tour with Kiwiana Tours Limited, high school students agree to obey KTL rules as summarised in the booking terms and conditions and as directed by the Tour Manager and Tour Assistants.

If a student breaks any rules or engages in conduct that could jeopardise the wellbeing of themselves or others, they cannot continue the tour and will be sent back to their host family at their own cost with no refund from KTL.

  • Students must not consume, possess or purchase alcoholic beverages or illegal drugs. If a student is found with drugs, New Zealand Police will be notified.
  • Students must have their natural parent or legal guardian sign the high-risk activities permission form before participating in bungy jumping, skydiving or any other high-risk activity, even if covered by insurance.
  • English should be used as the primary form of communication at all times.
